Disclaimer of Warranty:No conditions,representations or warranties,expressed or implied by law,are made or shall be deemed to be made by our company in respect of the Products or Manuals sold or provided hereunder,except for those provided for in the Service Policy and Warranty Procedure Manual in effect on the date of shipment of such Products by the Trading Company to the Distributor.Such WARRANTIES ARE EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES,EXPRESSED OR IMPLIED,INCLUDING,WITHOUT LIMITATION,ANY IMPLIED WARRANTY OF MERCHANTABILITY,FITNESS FOR PARTICULAR PURPOSE,OR SUCH OTHER IMPLIED WARRANTIES THAT MAY BE PROVIDED UNDER THE LAWS OF CHINA.The Distributor agrees,and agrees to cause the Dealers to agree,that the Distributor,Dealers and their customers shall not have any claim against MFTBC with respect to any warranty other than as expressly provided for herein.The warranty period with respect to the Products shall be as provided in Exhibit B.
Product Liability Insurance:The Distributor shall,at its own expense,obtain or arrange for product liability insurance on the Products purchased by the Distributor hereunder,of a type and in an amount equivalent to product liability insurance procured by competitive distributors in the Territory.our company,the Trading Company (or any other trading company subsequently used by company after the date hereof) and the Distributor shall be named insureds as their respective interests may appear.The Distributor shall promptly furnish our company and the Trading Company with a copy of any such insurance policy.
