10. The Bond shall be governed by and construed in accordance with the laws of the PRC for the time being in force. The Bondsman irrevocably agrees that the courts of the PRC are to have jurisdiction to settle any dispute or difference which may arise out of or in connection with the Bond and that accordingly any proceeding, suit or action arising out of or in connection with the Bond (“Proceedings”) may be brought in such courts. Nothing contained in this Clause shall limit your right to take Proceedings against the Bondsman in any other court of competent jurisdiction, nor shall the taking of Proceedings in one or more jurisdictions preclude the taking of Proceedings in any other jurisdiction, whether concurrently or not, to the extent permitted by the law of such other jurisdiction.
11. Any notice, demand or other communication to be given or made by you under the Bond shall be in writing signed by you or on your behalf and, without prejudice to any other means of serving any notice, demand or other communication, may be served by leaving it at, or sending it through the post in a prepaid envelope to the Bondsman at the address set forth below or by sending it by facsimile to the facsimile number of the Bondsman stated below; and a notice, demand or other communication so served shall be effective at the time it was so left, at the expiry of 48 hours after it was posted or when the transmission report generated by the facsimile machine used to dispatch it indicates that all of the pages of the notice, demand or other communication have been transmitted as the case may be.
