摘要：保险中的代位求偿,又称“代位追偿”或“权益转让”,是指保险标的由于第三人的责任发生保险事故而导致损失,保险人向被保险人支付保险赔款后,依法取得对第三人的请求赔偿的权利.保险中的代位求偿是财产保险以及同财产保险具有相同属性的损害补偿保险所专有的性质.在保险实务中,代位求偿权的行使,往往在保险人、被保险人、第三方之间存在很大争议,因此我们很有必要了解保险代位求偿的相关信息,本文首先通过对保险代位求偿权的含义、性质解释和了解；然后对保险代位求偿权的发生事由加以分析；其次保险代位权行使中应注意的几个问题加以说明；最后对目前保险代位求偿的两点争议进行讨论分析,以便把握保险代位求偿权的实质,正确开展代位追偿工作.

Abstract:the generation of insurance indemnity,say again "subrogation recourse" or "equity transfer" refers to the third party liability insurance mark due to loss occurs when insurance accident,the underwriter pays insurance indemnity to the insured to a third party,shall obtain the right of indemnity.Insurance of generation ask for compensation is property insurance and insurance has the same properties as property damage compensation insurance proprietary nature.In practice,the insurance of subrogation,often in the underwriter,insurant,third-party exists between the controversial,it is necessary to know the insurance and related information,this paper through the insurance of subrogation explanation and understanding of the connotation,properties,Then on insurance of subrogation due to happen to analyze,Secondly insurance subrogation right to exercise some problems needing attention in examples,On the current insurance and discuss the two controversial,to grasp the insurance of subrogation right in nature,and recovery work.
