劳务派遣业“三方”对《劳动合同法》实施的对策研究
劳务派遣作为一种新型的用工形式,已经在欧美等发达国家快速发展.作为一种客观存在,劳务派遣也在我国兴起,而且有进一步发展的趋势.由于劳务派遣中雇佣和使用分离的特性,在实践中产生了许多问题；而如何规范劳动派遣,曾经成为《中华人民共和国劳动合同法》立法过程中争论最为激烈的问题,2008年1月1日施行的《中华人民共和国劳动合同法》是一部尊重劳动,保护劳动者合法权益,维护稳定和谐的劳动关系的法律.对我国新兴的劳务派遣进行了前所未有的规范,打破了劳务派遣无法可依的局面,引起了全国大范围的轰动.《劳动合同法》主要的影响对象就是劳务派遣所涉及的三方当事者,即,派遣企业、用工单位和派遣劳动者.三方将如何应对新的法律条款,如何适应新的环境,如何维护自身的利益,成为了新法实施后的首要问题.本文通过对三方的影响分析,对三方在未来的发展对策提出了一些建议.
