本文着重论述我国实施缓刑制度的现状及在适用上,考察监督上存在的种种具体问题和弊端,影响法律的严肃性和司法的公正性.针对我国缓刑制度中存在的问题,从缓刑的适用条件,适用程序和考察监督制度等方面提出规范完善的建议,有效地抑制对缓刑的滥用,使缓刑的意义充分发挥出来.

随着世界人权观念的普及和各国对于死刑制度的持续声讨,我国要求减少死刑甚至废除死刑的呼声也日益高涨.现今,在学界基本一形成了以废除论为主导的潮流,有学者甚至提出：“仍然继续为死刑高唱赞歌,有违一个学者的良心”.那么,对于在野蛮时期产生,在这个高度文明的法治社会依然适用的死刑,是否应在中国走向现代化的道路中的废除呢?而废除死刑是否符合人类历史发展趋势?以下是本人就此问题的一些思考.

This article focuses on the probation system of China's present situation and,where applicable,the existence of inspection supervision and drawbacks of the various specific issues,the seriousness of the impact of legal and judicial impartiality.Probation system for China's problems,from the application of probation conditions,the application of inspection procedures and monitoring systems to regulate the recommendations to improve the effective suppression of the abuse of probation,a suspended sentence so that the full significance.

With the popularity of the world the concept of human rights and continued to denounce the death penalty system,my calls for a reduction or even abolition of the death penalty the death penalty is also the voice growing louder and louder.Today,the basic one in academia formed led to the abolition of the trend,some scholars have even proposed that:"the death penalty is still high for the singing,contrary to the conscience of a scholar." Then,in the brutal period of generation,in this highly civilized rule of law still applies the death penalty,whether it should be the path for China's modernization of the rescinded?And the abolition of the death penalty is in line with the trend of development in human history?The following are some of my thinking on this issue.
