摘 要
人权的普遍性原则从人最基本的尊严与价值这一基点出发,可分析为人权价值的普遍,人权主体的普遍与人权内容的普遍.关于人权的普遍性的争论已不是有无的问题,即使坚持人权特殊性的观点和学者也并未完全否认人权的普遍性,而主要是如何理解,如何实践的问题.本文认为强调人权的特殊性不能抹煞人权的普遍性,人权具有的普遍性是超越国界的；而人权的普遍性也不能否认人权的特殊性,人权的普遍性正是在它的千千万万个特殊性中实现的；两者应该辨证统一的来看.我们应该分阶段的逐步发展人权建设,以期最终达到普遍的人权.
