11.DOCUMENTS:
The Sellers shall present the following documents to the paying bank for
negotiation:
a.One (1) copy of Airway Bill marked “Freight Prepaid”.
b.Commercial Invoices one hundred percent (100%) of the total contract value in
three(3) Originals indicating contract number and shipping mark out in details as
per the contract concerned.
c.Detailed Packing List in three(3) originals,indicating name of commodities,
package number,weight ,relevant invoices number and signing date.
12.ADVICE OF DELIVERY:
After completion of loading the commodities on board of the vessel,the Sellers
Shall advise the Buyers by cable/telex/fax the contract number,description of the
commodities,quantity,gross weight,invoice value,flight number and the date .
13.WARRANTY & QUALITY OF COMMODITIES:
The Sellers guarantee that the commodities shall be made from best material and by the first workman-ship and newly manufactured.Quality specifications and performance of the products shall be in compliance with the provisions of this contract.The Sellers shall guarantee that the commodities,when correctly mounted and properly operated and maintained,shall be given ( 12 ) months warranty for the pertinent commodities from the date of the final-acceptance report signed by both sides.
17.ARBITRATION:
All disputes in connection with this contract or the execution thereof shall be settled through friendly negotiations.In case no settlement can be reached,the case shall be submitted for arbitration to the China International Economics and Trade Arbitration Commission,in Beijing,in accordance with its Rules of Arbitration.The decision of the Arbitration Commission shall be final and binding upon both parties.
Neither party shall seek recourse to a law court nor other authorities to appeal for revision of the decision.Arbitration fee shall be borne by the losing party unless
other wise awarded.
