Prior to the commencement of performance tests, it shall be the responsibility of the Contractor to ensure, that all equipment, items, materials, services, works, facilities etc which constitute the operating group as well as all equipment, items, materials, services, works, facilities etc which constitute the components servicing the operating group have been installed and completed according to the Contract. If during this process, it is noted that the same is incomplete, then the commencement of performance tests shall be kept in abeyance till such time the Contractor completes all the incomplete works to the satisfaction of the Company. However, the missing of minor parts shall not constitute a reason for postponing the test because of incompleteness, if these parts do not influence the performance test and if the Contractor has already agreed to supply these parts promptly.
On receipt of Contractor's notification indicating his proposed date of commencement of performance test of any operating group, as per Clause 1.2above, the Company shall advise the Contractor his acceptance or otherwise of proposed date of commencement of performance tests provided that the new date, if any, advised by the Company for commencement of performance tests shall not exceed one month's time from the date of receipt of the Contractor's aforesaid notification subject to the Contractor's ensuring that all equipment, items, materials, services, work, facilities etc which constitute the operating group as well as the components servicing the operating group have been erected and completed according to the Contract Technical Specification.
