Development and Theory ：The Anglo-American system of law is an adversary system.It is,in other words,a system which arrives at a decision by（1）having each side to a dispite present its best case and（2）then permitting a neutral decision-maker to determine the facts and apply the law in light of the opposing presentations of the two sides.In the criminal case,the opposing parties are the state,representing the victim and the general public,and the defendant.Their legal representatives are the prosecuting attorney and the defense attorney.The neutral finder of fact is usually the jury and the neutral finder of law is the judge,although the judge also will serve as the fact-finder when the jury is waived.
