China鈥檚 quo status for news media鈥檚 reporting rights are far beyond satisfaction,despite the comedic ending for journalist Qiu Ziming,whose name was once on a wanted list by police authorities for writing about alleged insider trading at a state-run company,but crossed due to public pressure in late July.For safeguarding citizens鈥 rights of free expression and publication,an independent and impartial legal system is vital.

The fertile soils into which the terror planted in the news industry are not changed together with Qiu Ziming鈥檚 freedom amid uproar.
Despite the dramatic closure of the case,concerns over journalists鈥 freedom and rights are mounting,catching eyes from the public,especially in the media industry.
Described as a temporary victory for journalism in a certain sense by the public,Mr.Qiu鈥檚 freedom also marks a step of growing up for the media industry,the so-called 鈥渢he fourth estate.鈥滭br/>Since the disclosure of the news on sina twitter on 28 July,it appears in all kinds of media,discussed and commented by the public,including Mr.Qiu鈥檚 employer the Economic Observer,who issued a statement on its website,saying the newspaper is 鈥渃ommitted to using all legal means to defend the legitimate rights of the media and journalists to conduct interviews and engage in reporting,in order to jointly maintain the healthy supervision of the public sphere.鈥滭br/>Under the pressure of public outcry,local police rescinded the detention order on July 29 and made an apology to Mr.Qiu the next day.
It is gratifying to note that amid the uproars,China鈥檚 journalism is gaining strength and becoming a growing force that cannot be neglected.However,it is still stunted compared with the strong and independent media force in the west,which is called 鈥渢he fourth estate鈥 on par with churchman,nobleman and civilian.Lack of independence and power that may compete with other powers,the journalism sometimes is nothing but a target for mockery.
However,the case startles us in some way,bringing with glimmers of hope that China鈥檚 journalism is on its way to combination and growing into one of the important forces in China.
It is certain that as an individual case,it cannot be overrated.In fact,troubles for China鈥檚 media are far more than that.Amongst them,a major threat comes from government authorities.China鈥檚 Constitution stipulates in article 35 that the freedom of speech and the liberty of the press are fundamental rights of citizens,which,however,can hardly be realized in practice.
One of the reasons is that the enforcement of laws depends on co-operations from legal departments,administrative department and judicial departments,without any of whom,the Constitution is a dead letter.Specifically,when making laws,legal authorities should obey the principles of the Constitute while administrative departments should strictly follow legal procedures without distortion or violence abuse.When it comes to handling cases,an independent and just judicial system should be guaranteed.
Of the 鈥渢roika鈥 system,the role of juridical departments is of great importance to protect citizens鈥 essential rights and freedom because of its functions to contain legal and administrative departments.
In other words,freedom and rights can never be left entirely,as long as an independent and just juridical system is functioning.
Meanwhile,the powers from administrative departments are the most destructive and threatening to freedom and rights.Imagine,when a police authority is 鈥渃aptured鈥 by money,anyone like Mr.Qiu will be caught under a paper of warrant.Anything would happen to Mr.Qiu without the exposure and support from media.

What we should do is to shape such a system with combined efforts from every circle of the society.That鈥檚 the only way leading to citizens鈥 freedom of speech and liberty of the publication.
The history of press freedom from western counties under the rule of law provides us examples to follow.In 1735,John Peter Zenger,editor and chief writer of the New-York Weekly Journal was brought to trial on August 4 for publishing articles criticizing local government.The twelve colonial jurors found Peter Zenger not guilty at last despite obstructions from the colonial governor,signaling the power of an independent juridical system.
Of course,professional ethics and knowledge are also vital to the expansion of the 鈥渇ourth estate.鈥 As a discloser of fact and a supervisor of authorities,journalist should stand his or her ground and stay away from transactions for illegal or immoral benefits.
