However on May, 4th this year we have received the letter-prevention from the Russian company "MegaStandard" (the copy is applied) that Joint Stock Company “Canonpharma production” in the course of purchase API from “Razpharma Ltd.” violates certain conditions of exclusive agreements between your company (“Jiangling Benda Pharmaceuticals Co., Ltd.”) and the company “Chengde Miracle Pharmaceutical Co. Ltd.” on shipments of Ribavirin to Russian Federation. This letter also describes that there is certain exclusive agreement between “Chengde Miracle Pharmaceutical Co. Ltd.” and “NC Pharm”. That means that any company has no possibility for official import of Ribavirin of “Jiangling Benda Pharmaceuticals Co., Ltd.” to Russia, except as through “NC Pharm”. Nevertheless, according to other second supplier information, the agreement on exclusive purchases of Ribavirin in Russia between your company and someone from the Russian traders does not exist.
As Joint Stock Company “Canonpharma production” strictly observes requirements of the legislation of Russia and is the diligent purchaser of substances including Ribavirin manufacturing by your company, we address to you with the request to direct to our address the following information:
1. Does exclusive agreements on delivery of Ribavirin manufacturing by your company to Russia exist? If yes, we would be grateful if you could sent us copies of these agreements. If there is not exclusive agreement on Ribavirin purchasing between you and any Russian or Chinese company we also kindly ask to inform us.
2. Have you an original copy of Ribavirin RC? If not, we kindly ask you to inform us to what Russian company you gave the right to dispose RC.
3. Also we kindly ask you to inform us if you officially sent notarially certified copy of Ribavirin RC to any Russian or Chinese company, besides “NC Pharm” and company “Chengde Miracle Pharmaceutical Co. Ltd.”.
4. Please inform us if the CoA of the Ribavirin batch 100107 is really realized and signed by “Jiangling Benda Pharmaceuticals Co., Ltd.” and if this batch realized for the shipment to Russian Federation.
5. Please inform us about the date of manufacturing of Ribavirin batch 110111 (please find a CoA of this batch enclosed). Also please confirm that this batch has been manufactured for Chengde Miracle Pharmaceutical Co. Ltd.” by Jiangling Benda Pharmaceuticals Co., Ltd.
