1.Treatment of Confidential Information
The parties agree with respect to the confidential information of the other respective party that they will
a) is or becomes generally known without the recipient being responsible for this;
b) was already known to the recipient without this being due to a third party’s breach of a duty to observe secrecy towards the other party;
c) was previously,independently acquired by the recipient,
d) make it accessible neither to their employees nor third parties other than while maintaining the confidentiality.Those employees and third parties who require the information for performing the task as contemplated under the cooperation; have to be contractually bound to confidentiality by the respective recipient of the information;
e) not to devote less care or to apply less stringent security measures to the other party’s confidential information than the recipient applies to its own confidential or protected information.
